Our website address is https://canarystay.eu. CanaryStay® is the name of our company. CanaryStay® is a registered company in Spain, and the name is also a registered trade mark, herein referred to as ‘the website’ in this document.

By using the Canarystay.eu website as a renter or property owner/manager, or Partner you agree to the terms, conditions and policies described below.

CanaryStay® provides a website medium for vacation rental property owners and agents to become a Partner and to self-publish vacation rental listings for properties ONLY within the Canary Islands. CanaryStay® does not edit vacation home listings, except in cases where owners/agents have published objectionable or disallowed content. CanaryStay® does not put owners and their guests in touch with each other, this is done directly via the registered Partner’s page.

CanaryStay® does not validate the ownership of any vacation rental property listing, or validate the legitimacy of any renter. CanaryStay® is not responsible for any vacation home licensing that may be required by Spanish law. CanaryStay® is not responsible for the accuracy of any content published by a vacation property owner/agent, nor any claims made by a property owner/agent or renter. Renters and property owners/agents agree to assume all liability for any transactions resulting from the use of the Canarystay.eu website.

COMPLIANCE NOTICE: Please be aware that short-term rentals are subject to local laws that provide who may rent their property and how such rentals may operate. You should review local laws to determine whether your property may be made available for rent and the requirements with which you must comply. Many jurisdictions require a Touristic licence before renting. Penalties include fines and other enforcement. CanaryStay® has not determined whether your property may qualify as a short-term rental and listing your property on canarystay.eu should not be considered as any indication that your property rental is allowable under applicable Canary Island laws.

CanaryStay® is not party to any transaction between a vacation rental owner/agent and a prospective or actual renter, either inside or outside of the website. By using the website, you agree that CanaryStay® shall not be held liable for any direct or consequential loss or damage from using the website. You agree that your sole and exclusive remedy against CanaryStay® is to discontinue using the website.

Each vacation home owner/agent has access to their listing 24 hours per day, except in the case of scheduled or unscheduled outages. CanaryStay® does not warrant that website service will be uninterrupted.

CanaryStay® does not create listings or edit listings. Each vacation home owner/agent is responsible for creating his/her listing, maintaining the accuracy and currency of the listing and deleting the listing when it is no longer wanted. Expired listings are automatically deleted. Listing purchases are final and no refunds are issued once a listing has been purchased. Listing fees are charged as a percentage of each booking at the amount of 4.5% plus credit card processing up to a maximum of 20%. Processing charges vary and are dependent on the location of the guest and the method of payment chosen, as well as the withdrawl method the partner has allocated to recieve their funds. This charge covers the cost of advertising on the website, credit card payment processing and forwarding to the owner/agent and ongoing website maintenance and improvements.

On creating a new listing, the Owner /agent agrees to ensure that any pre-existing calendar dates are booked out accurately, using the ical calender provided. CanaryStay® shall not be held liable for errors in the calendar bookings, double bookings or failure to update the calendars.

PARTNER PROGRAM

The CanaryStay® Partner Program is for anyone who owns a Hotel, Vacation Rental, Airline Company, Car Hire or Holiday type activity in the Canary Islands. Join our marketplace to gain worldwide exposure to your business. It’s free to join, and we charge a small commission when you get a booking. Payment are made on the 25th of each month to your chosen banking institution. Refunds are between the guests and the booking service they have chosen to use.

CanaryStay® is not responsible for the content displayed on the website from our Partners or our Affiliate Partners. All prices, bookings and enquiries must be directed to the booking partner who has been used for the booking, and not CanaryStay®.

CanaryStay® does not warrant that the website is error free. Each vacation property owner/agent establishes his/her own cancellation and refund policy. CanaryStay® is not responsible for the payment or refund of any fees or deposits. CanaryStay® is not a property manager and does not represent any owner/agent or renter. CanaryStay® does not mediate or otherwise participate in any deposit or rental payment dispute between an owner/agent and a renter.

CanaryStay® recommends that property owners/agents and renters assume that any potential transaction may be fraudulent and that positive steps be taken to establish the legitimacy of the transacting party.

CanaryStay® reserves the right to update this page as it’s discretion and without notice.

LISTING AND ACCEPTABLE CONTENT POLICY

CanaryStay® reserves the right to delete or deactivate any vacation rental listing at its sole discretion with or without notification. No pornographic, discriminatory or unlawful content or fraudulent activity is permitted. Each listing may link to one Vimeo or YouTube video for displaying the vacation property and surroundings, and unlimited calendar syncing feeds from other vacation rentals website is permitted.

A vacation rental property may only be posted for properties located on one of the Canary Islands and not be posted to an overtly incorrect city (e.g. posting a Lanzarote listing under a Tenerife location). Any such improper posting shall result in the deletion of the listing without notification.

For pre-existing guests who have booked with a non refundable property, but who have been offered replacement dates, Owners and Property Managers agree to manually make changes to the calendar dates on the website and provide CanaryStay® with evidence that the change is replacement dates and not a new booking.

LISTING INQUIRIES

While CanaryStay® endeavors to eliminate spam/fraudulent inquiries sent to listing owners/agents, it is not possible to guarantee that no such inquiries will be received by a listing owner/agent. Any listing owner/agent who receives a suspect inquiry is encouraged to notify CanaryStay® via the contact us form. CanaryStay® shall be held blameless and harmless for any cases of fraud resulting from transactions conducted through the Canarystay.eu website, whether as owner/agent or renter.

By using the website either as an owner or a guest, you agree to receive periodic newsletters from CanaryStay®. You may opt-out of the newsletter at any time. We normally only send one or two newsletters per year, so the frequency is not high.

PARTNER LINKS

CanaryStay® website contains affiliate links to products. We may receive a commission for purchases made through these links.

COMMENTS

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. After approval of your comment, your profile picture is visible to the public in the context of your comment.

MEDIA

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

COOKIES

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

HOW LONG WE RETAIN YOUR DATA

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
